Dojo Storm Terms of Use

These terms and conditions ("Terms") apply to the Dojo Storm app for mobile devices (the "Application"), operated by DOJO STORM LLC ("we," "us," "the Service Provider"). By downloading or using the Application, you agree to these Terms. Read them carefully — in particular the Assumption of Risk section below, which applies because this Application is used to organize live physical combat sports matches between users.

Eligibility and Age Requirement

You must be at least 16 years of age to use the Application. If you are below 16, a parent or legal guardian must review and accept these Terms on your behalf, and takes responsibility for your use of the Application, including your participation in any match arranged through it. By using the Application, you represent that you meet this requirement and are legally permitted to use it in your jurisdiction.

License to Use the Application

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal use. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as and only to the extent expressly permitted by applicable law.

Intellectual Property

We retain all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. Nothing in these Terms grants you any license or right to use our trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notice displayed in or on the Application.

Assumption of Risk; Combat Sports Disclaimer

This is the most important section of these Terms. Please read it carefully.

The Application is a scheduling and ranking tool for a martial arts tournament. It facilitates arranging real, physical, full-contact matches between competitors — it does not referee, supervise, insure, or otherwise participate in those matches, which take place in person, outside the Application, at a time and location the participants agree to.

By using the Application to send, receive, accept, or participate in a challenge, you acknowledge and agree that:

If you are not willing to accept these risks, do not use the Application to arrange or participate in matches.

Self-Reported Results; No Guarantee of Accuracy

Match weigh-ins, referee information, and outcomes are self-reported by the competitors who fought the match. The Application provides a mechanism for the competitor who did not submit a result to confirm it or report a discrepancy, and disputed results are reviewed by an administrator — but the Service Provider does not independently verify match results and makes no guarantee of their accuracy. Tournament rankings are based on this self-reported data.

User-Generated Content and Acceptable Use

If the Application allows you to post, share, or upload content (including profile photos, match videos, notes, and discrepancy reports), you agree not to post content that:

We reserve the right to remove or disable access to content that violates these guidelines, suspend or terminate accounts of users who repeatedly violate them, cooperate with law enforcement if illegal content is reported, and otherwise moderate, filter, or hide content that violates these Terms or applicable law. Content submitted through the Application may be visible to other competitors, depending on how the Application functions (see our Privacy Policy).

If you believe content violates these Terms, infringes your rights, or is unlawful, report it to us at admin@dojostorm.app with enough detail for us to identify the content and evaluate the report.

Account Suspension and Termination

Separately from the automated challenge-responsiveness enforcement built into the Application (which may temporarily freeze your ability to issue new challenges after repeated missed responses, and which an administrator can reverse), we may suspend or terminate your access to the Application if you materially breach these Terms. Where the breach is capable of cure, we will provide written notice and you will have 14 days from receipt to remedy it; if you fail to do so, we may terminate your access. We may suspend or terminate your access immediately, without notice, if you violate applicable law, infringe intellectual property rights, or engage in conduct that could cause harm to other users or to us — including conduct occurring at or around a match arranged through the Application.

Upon termination, your right to use the Application ends and you must delete all copies from your devices. You may also delete your own account at any time via Settings → Delete My Account.

Disclaimer of Warranties

The Application is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Application will be uninterrupted, error-free, or secure, or that rankings, match records, or challenge notifications will always be accurate or timely.

Limitation of Liability

To the fullest extent permitted by applicable law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising out of or related to your use of the Application or any match arranged through it — including, without limitation, any personal injury sustained during a match. Our total liability for any claim arising out of or relating to these Terms or the Application shall not exceed the amount, if any, you paid us to use the Application in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless the Service Provider from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Application, your participation in any match arranged through it, your violation of these Terms, or your violation of any right of a third party.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the state in which the Service Provider is organized, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Application will first be attempted to be resolved informally by contacting us at admin@dojostorm.app; if not resolved within 30 days, either party may pursue the dispute in a court of competent jurisdiction in that state.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last Updated" date above. Continued use of the Application after a change constitutes acceptance of the updated Terms.
